Welcome to Branding Masters("we," "us," or "our"). These Terms and Conditions ("Terms") govern your access to and use of our affiliate network website, platform, and tracking services (collectively, the "Network").By registering an account as an Affiliate (Publisher) or Advertiser, or by using the Network, you agree to be bound by these Terms. If you do not agree, you must immediately stop using our services.

1.ACCOUNT REGISTRATION AND ELIGIBILITY

• Minimum Age: You must be at least 18 years old to create an account.
• Accurate Information: You must provide true, accurate, and current information during registration. You are responsible for keeping this information updated.
• Account Security: You are entirely responsible for maintaining the confidentiality of your account login credentials. You accept responsibility for all activities that occur under your account.
• Right to Refuse: We reserve the right to reject any account application for any reason at our sole discretion.

2. AFFILIATE (PUBLISHER) OBLIGATIONS & PROHIBITED ACTIONS

As an Affiliate, you are granted a non-exclusive right to promote Advertiser campaigns in exchange for commissions. 

You strictly agree not to engage in any of the following prohibited marketing practices:

• Fraudulent Traffic: You will not generate artificial traffic, clicks, leads, or sales using bots, automated scripts, manual clicking, or incentivized setups (unless specifically allowed by the campaign).
• Spam: You will not promote links through unsolicited emails, mass forum posts, or any form of spam.
• Misleading Claims: You will not make false, deceptive, or exaggerated claims about the products or services you promote.
• Brand Bidding: You will not bid on trademarked keywords (e.g., Google Ads) belonging to Advertisers or our Network without express written permission.
• Compliance with Laws: You must comply with all local advertising laws, including mandatory consumer disclosures (e.g., clearly stating that you earn a commission from the links).

3. ADVERTISER OBLIGATIONS

As an Advertiser, you supply the marketing campaigns, landing pages, and tracking requirements to the Network.

• Campaign Truthfulness: Your landing pages, products, and services must be legal, functional, and accurately described.
• Tracking Code Integrity: You must maintain our tracking pixels or postback URLs on your conversion pages. Intentionally removing or altering tracking codes to avoid paying commissions is a material breach of these Terms.
• Timely Validation: You must review and validate generated leads or sales within the timeframe agreed upon in your specific campaign setup.

4. COMMISSION PAYMENTS AND FEES

• Tracking Determinations: Our Network’s tracking logs, statistics, and data are the definitive and sole basis for calculating commissions and fees.
• Payment Terms: Affiliates will be paid according to our standard payment schedule (e.g., Net-15, Net-30) provided they meet the minimum payment threshold.
• Chargebacks and Reversals: We reserve the right to withhold, deduct, or claw back commissions from an Affiliate account for cancelled orders, customer refunds, or traffic later determined to be fraudulent.
• Taxes: Affiliates are solely responsible for reporting and paying all local, state, or federal taxes associated with earnings from the Network.

5. TERMINATION AND SUSPENSION

• Termination by Us: We reserve the right to suspend or terminate your account immediately, without notice, if we suspect you have breached these Terms or engaged in fraudulent activity.
• Forfeiture of Earnings: If your account is terminated due to fraud, compliance violations, or illegal activity, all pending and unpaid commissions will be permanently forfeited.
• Termination by You: You may terminate your account at any time by contacting our support team and ceasing all use of our tracking links.

6. INTELLECTUAL PROPERTY

• Network Ownership: All software, tracking technology, logos, trademarks, and website content are the exclusive property of [Insert Company Name].
• Limited License: You are granted a limited, revocable, non-transferable license to use our tracking links and promotional creative assets solely for participating in our Network.

7. LIMITATION OF LIABILITY AND DISCLAIMERS

• "As-Is" Service: The Network is provided on an "as-is" and "as-available" basis. We make no guarantees that our website, tracking platform, or links will be completely error-free or uninterrupted.
• No Profit Guarantees: We do not guarantee that your participation in the Network will result in any specific amount of revenue or profit.
• Maximum Liability: To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, or consequential damages (including loss of profits or data) arising out of or related to these Terms, regardless of the cause of action.

8. GOVERNING LAW AND DISPUTE RESOLUTION

These Terms shall be governed by and construed in accordance with the laws of United Kingdom, without regard to its conflict of law principles. Any legal action or dispute arising under these Terms must be resolved exclusively in the courts located in United Kingdom

9. CHANGES TO THESE TERMS

We reserve the right to modify these Terms at any time. We will provide notice of material changes by updating the effective date at the top of this document or via your network dashboard. Your continued use of the Network after changes are published constitutes your acceptance of the revised Terms.
